Instagram Sweepstakes Terms and Conditions

1. Sponsorship and Eligibility
This contest is sponsored by Epione Medical Corporation, 444 N. Camden Dr., Beverly Hills, CA 90210. There is no purchase necessary to enter or win. This contest is open to legal residents of the United States who are eighteen (18) years or older at the time of entry; however, the contest is void where otherwise prohibited or restricted by law. Employees of Epione Medical Corporation, its affiliates, licensees, franchisees, advertising and promotional agencies and the immediate family members of each are not eligible. This contest is in no way endorsed or sponsored by Instagram or Facebook.

2. Qualification Period
The qualification period for the contest prize begins at 7:00 AM (PST) on March 28, 2022 and ends at 11:59 PM (PST) on March 31, 2022.

3. Entry Procedures
To enter the contest, entrant must have an account on Instagram with a public profile and must “follow” the account @simonourianmd1. Entrants shall like and comment on the promo post(s); they shall “tag” at least three (3) friends in their comment(s). No mechanically generated entries accepted. Tagged profiles must be individual profiles; business or product profiles are not counted. To complete entry, entrants must send their Instagram user name via SMS to +12138067853 right after completing prior steps. Multiple entries allowed. All aforementioned requirements must be met for an entry to be valid.

4. Duties of Participants; Limitation of Liability
By entering, participants agree to be bound by these rules and the decisions of Epione Medical Corporation, which shall be final. All federal, state, and local laws apply. Epione Medical Corporation and the employees, officers, directors, shareholders, agents, and representatives of Epione Medical Corporation, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible or liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Epione Medical Corporation that may cause the contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the contest; or (vi) any printing or typographical errors in any materials associated with the contest.

5. Violation of Contest Rules
Epione Medical Corporation reserves the right to disqualify any participant or winner who, in its sole suspicion, tampers with the entry process, violates these rules or the Instagram Terms and Conditions, or acts in an unsportsmanlike or disruptive manner.

6. Selection of Winner; Chances of Winning
Major prize winner will be selected within 6-30 hours from the end of the qualification period in a random drawing held from among all eligible entries received. Odds of winning depend on the total number of entries received.

Multiple second prize winners will be selected at random. Odds of winning depend on the total number of entries received.

7. Description of Prize
One major prize and several second prizes are available via the contest.

7.1. Major Prize
The major prize includes a one-on-one Fox Eyelift consultation at Epione Medical Corporation and, if winner is medically deemed a candidate for the procedure and completes all requested legal and medical consent documentation, one Fox Eyelift procedure performed by Dr. Simon Ourian™. If winner is not deemed a medical candidate for the procedure, winner will instead receive one (1) Epione Signature Series Skincare Box Set and one (1) SonicTouch Sonic Skin Cleansing System for Face and Body.

7.2. Second Prizes
Several Gift Certificates for 50% off Fox Eyelift by Dr. Simon Ourian™ would be distributed three days to one week after the promo ends.

By accepting the gift certificate, winners agree to the following terms:
The national average cost of Fox Eyelift is $15,000. With the gift certificate, patients get 50% off; average cost then becomes $7,000. Actual pricing will be discussed during the in-person consultation. The gift certificate includes one free in-person consultation with Dr. Simon Ourian’s senior associate, but virtual consultation fees are not covered by the gift certificate.

Gift certificate is non-transferable and may only be applied towards the treatment of one patient. Gift certificate bearer must be able to physically come to Epione Beverly Hills within the validity period to claim prize. Gift certificate is nonrefundable or redeemable for cash and may not be combined with other gift certificates or offers or applied to previous purchases or procedures. A consultation may be required. Results not guaranteed. Additional and/or alternate treatments may be needed to achieve the desired result. Void where prohibited or not deemed medically safe.

For all prizes, both consultation and the procedure will be performed at Epione Medical Corporation’s office at 444 North Camden Drive, Beverly Hills, CA 90210. Winners are responsible for their travel expenses to and from Beverly Hills. Procedure results are not guaranteed. Additional and/or alternate treatments may be needed to achieve desired results. Winners may require post-procedure “social downtime” due to swelling, bruising, redness, or other temporary side effects.

8. Notification of Winner; Substitution of Prizes

8.1. Major prize winner
The major prize winner will be announced publicly via Instagram account @simonourianmd1. The winner shall contact Epione Medical Corporation via email at info@epione.com or telephone at +1 (310) 271-6506 to claim the prize. Epione Medical Corporation will attempt to respond to winner via telephone or email up to three times. If the winner does not respond to email and/or telephone notification within three days of its transmission, or should the email and/or telephone call be undeliverable after three attempts, the prize will be forfeited and an alternate winner will be selected. The winner may not substitute or transfer prizes. Epione Medical Corporation reserves the right to substitute a prize of equal or greater value in the event a prize is unavailable. Prizes are not redeemable for cash. All taxes on prize are winner’s responsibility. Winner must redeem prize within thirty (30) days of the date of notification.

8.2. Second prize winners
Second prize winners will be contacted via SMS and/or Instagram Direct Message. They shall express intent to claim prize by either responding to the message or calling the office to schedule their consultation and treatment appointments. Unclaimed prizes will be awarded to other promo entrants in random. Second prizes (gift certificates) are nonrefundable or redeemable for cash and may not be combined with other gift certificates or offers or applied to previous purchases or procedures. Failure to express intent to claim and visit the office within the set period means automatic disqualification.

9. Permissions
By entering the sweepstake, entrants agree to allow Epione Beverly Hills to contact them via Instagram Direct Messages, SMS, or phone calls. Except where prohibited by law, entry constitutes permission to use winners’ name, hometown and likeness for online posting, and/or any advertising and publicity without additional compensation. Winner may also be required to sign and return a release of liability, declaration of eligibility and, where lawful, a publicity consent agreement, as conditions of receiving a prize. Failure to comply with the aforementioned conditions shall be grounds for forfeiture of a prize.

By getting the aforementioned procedure done, major prize winner gives Epione Beverly Hills the right to use before and after photos and/or procedure videos for marketing and advertising purposes wherever and whenever the company deems applicable.

11. Jurisdiction
The contest shall be governed by and interpreted in accordance with the laws of the State of California applicable to promotions fully carried out within California. Except where prohibited by law, any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest but in no event attorneys’ and/or experts’ fees. By entering the contest, entrants waive all rights to claim punitive, incidental and consequential damages and any other damages (including attorneys’ fees), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Entrants acknowledge that no other party nor any agent or attorney of any other party has made any promise, representation or warranty whatsoever, express or implied, not contained herein concerning the subject matter hereof, to induce entrant to execute any document and entrant acknowledges that he/she has not executed any document in reliance on any such promise, representation or warranty not contained herein.
