Instagram Sweepstakes Terms and Conditions

1. Sponsorship and Eligibility

This contest is sponsored by Epione Medical Corporation, 444 N. Camden Dr., Beverly Hills, CA 90210. There is no purchase necessary to enter or win. This contest is open to legal residents of the United States who are eighteen (18) years or older at the time of entry; however, the contest is void where otherwise prohibited or restricted by law. Employees of Epione Medical Corporation, its affiliates, licensees, franchisees, advertising and promotional agencies and the immediate family members of each are not eligible. This contest is in no way endorsed or sponsored by Instagram or Facebook.

2. Qualification Period

The qualification period for the contest prize begins at 7:00 PM (PST) on April 21, 2022 and ends at 7:00 PM (PST) on April 22, 2022.

3. Entry Procedures

To enter the contest, entrant must have an account on Instagram with a public profile and must “follow” the account @simonourianmd1. Entrants shall like and comment on the promo post(s); they shall “tag” at least three (3) friends in their comment(s). No mechanically generated entries accepted. Tagged profiles must be individual profiles; business or product profiles are not counted. Multiple entries allowed. All aforementioned requirements must be met for an entry to be valid.

4. Duties of Participants; Limitation of Liability

By entering, participants agree to be bound by these rules and the decisions of Epione Medical Corporation, which shall be final. All federal, state, and local laws apply. Epione Medical Corporation and the employees, officers, directors, shareholders, agents, and representatives of Epione Medical Corporation, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible or liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Epione Medical Corporation that may cause the contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the contest; or (vi) any printing or typographical errors in any materials associated with the contest.

5. Violation of Contest Rules

Epione Medical Corporation reserves the right to disqualify any participant or winner who, in its sole suspicion, tampers with the entry process, violates these rules or the Instagram Terms and Conditions, or acts in an unsportsmanlike or disruptive manner.

6. Selection of Winner; Chances of Winning

Four winners will be selected within an hour after the end of the qualification period in a random drawing held from among all eligible entries received. Odds of winning depend on the total number of entries received.

7.Description of Prize

Four prizes are available via the contest. Prizes includes one-on-one, in-person consultations at Epione Medical Corporation and, if winners are medically deemed candidates for the procedure and complete all requested legal and medical consent documentation: one (1) non-surgical facial contouring, one (1) non-surgical eye bags removal, one (1) non-surgical nose job, and one (1) non-surgical lip augmentation to be awarded to four (4) different winners. If winners are not deemed medical candidates for the procedure, winners will instead receive one (1) Epione Signature Series Skincare Box Set and one (1) SonicTouch Sonic Skin Cleansing System for Face and Body each. Alternative winners may be chosen should the initial winners not be able to redeem prize within the specified redemption period (April 23-24, 2022).

8. Notification of Winner; Substitution of Prizes

Winners will be announced publicly via Instagram account @simonourianmd1. Winners shall contact Epione Medical Corporation via email at info@epione.com or telephone at +1 (310) 271-6506 to claim the prize. They would also be contacted via Instagram Direct Message through the said Instagram account. If the winner(s) does not respond to confirm interest within three (3) hours from the announcement, the prize will be forfeited and an alternate winner(s) may be selected. Winners may not substitute or transfer prizes. Epione Medical Corporation reserves the right to substitute a prize of equal or greater value in the event a prize is unavailable. Prizes are not redeemable for cash. All taxes on prize are winner’s responsibility. Winners must have the treatment done over the weekend of April 23 to 24, 2022 only; unavailability within the said timeframe forfeits prize and alternative winners may be drawn.

9. Permissions

By entering the sweepstake, entrants agree to allow Epione Beverly Hills to contact them via Instagram Direct Messages, SMS, or phone calls. Except where prohibited by law, entry constitutes permission to use winners’ name, hometown and likeness for online posting, and/or any advertising and publicity without additional compensation. Winner may also be required to sign and return a release of liability, declaration of eligibility and, where lawful, a publicity consent agreement, as conditions of receiving a prize. Failure to comply with the aforementioned conditions shall be grounds for forfeiture of a prize.

By getting the aforementioned procedure done, winners give Epione Beverly Hills the right to use before and after photos and/or procedure videos for marketing and advertising purposes wherever and whenever the company deems applicable, and agree to be filmed for a show—with this, winners also give the filming company and companies affiliated to filming and the show the rights to film and show procedure videos and before/after photos/videos to wherever and whenever the companies deem applicable.

11. Jurisdiction

The contest shall be governed by and interpreted in accordance with the laws of the State of California applicable to promotions fully carried out within California. Except where prohibited by law, any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest but in no event attorneys’ and/or experts’ fees. By entering the contest, entrants waive all rights to claim punitive, incidental and consequential damages and any other damages (including attorneys’ fees), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Entrants acknowledge that no other party nor any agent or attorney of any other party has made any promise, representation or warranty whatsoever, express or implied, not contained herein concerning the subject matter hereof, to induce entrant to execute any document and entrant acknowledges that he/she has not executed any document in reliance on any such promise, representation or warranty not contained herein.
